Who can be Sued in a Defective Product Liability Claim?

by David Peel on January 8, 2014

Who can be Sued in a Defective Product Liability ClaimWhen a person is injured by a defective product, he may wish to file a lawsuit to recover for his injuries. It is important that the person know who he can sue for his injuries.

The injured person could file a lawsuit against the manufacturer. This includes the manufacturer of a defective piece, if applicable, in the product. It also includes the manufacturer of the whole product. Since the manufacturer builds the product, it could be liable for any defects within the product.

The injured person could also file a lawsuit against any design consultant the manufacturer used. This is the case if the injury occurs because of a defect in how the product was designed. Or, the injured person could file a lawsuit against a technical expert used by a manufacturer if the claim involves failure to warn or provide adequate instructions.

The injured person could file a lawsuit against the retailer. Even though the retailer did not make the product, it can still be liable to the injured person for selling a defective product. It is important to know that the injured person does not have to be the person who bought the product. He does not even need to be the person who used the product. He just needs to be injured by the defective product sold by the retailer.
